PRIVACY NOTICE

What does this privacy notice cover?

This privacy notice describes how the British Horseracing Authority Limited (also referred to as “the BHA“, “we” or “us“) will make use of your data in order to manage and administer the www.careersinracing.com website (our site) and when you apply for any of our training and education programmes, apprenticeships or to be added to our talent pool.

It also describes your data protection rights, including your right to object to some of the processing which the BHA carries out. For more information about your rights, and how to exercise them, go to the “What rights do I have?” section.

What information do we collect?

Website users

In order to administer the site, we collect and process personal data about you when you:

• fill in your details on our site, register for our newsletter and participate in any interactive functions on our site or when you report a problem with our site;
• fill in your details or register for our newsletter via any of our landing pages;
• fill in your details or register for our newsletter using a Racing to School contact form or other such contact form such as feedback forms provided at training providers and equine colleges;
• enter one of our competitions;
• otherwise provide your details to us by phone, e-mail or in writing.

The information you give us may include your name, e-mail address, date of birth and location.

Applicants

When you submit an application for a training or education programme placement, apprenticeship or to be added to our talent pool we collect and process personal data you provide to us in your application, such as:

• your name;
• your gender;
• your age/date of birth;
• your ethnicity;
• your home address, email address and phone number;
• your height and weight; and
• other details provided in your application form and CV, such as references, work history and qualifications. It may also include additional personal data that is not required but that you may choose to provide.

What information do we receive from third parties?

When you submit an application directly, we may receive information about you from third parties. In particular, from your current or previous employers, your school, college or university or other third parties that you have suggested to provide references.

When you submit an application through one of our recruitment partners, such as the 10,000 Interns Foundation, we will have access to the information you provide in your application and CV.

We may also carry out open-source internet searches on websites such as Google, Facebook and Linked In.

How do we use this information, and what is the legal basis for this use?

We process this personal data for the following purposes:

• As required by the BHA to conduct our business and pursue our legitimate interests, in particular:
  • to consider and administer your application.
  • to respond to any comments or complaints you may send us;
  • to help us monitor, improve and protect our products, content, services and websites, both online and offline;

• we will use your information to send you marketing where we don’t need your consent (via post, phone or targeted direct marketing via the internet), such as through social media sites;

• we will use data in connection with legal claims, compliance, regulatory and investigative purposes as necessary (including disclosure of such information in connection with legal process or litigation); and
• where you give us consent:
  • we place cookies and use similar technologies in accordance with our Cookies Policy and the information provided to you when those technologies are used;
  • to provide you with newsletters for which you have chosen to subscribe;
  • for marketing on social media platforms (e.g. ‘custom audience’);
  • to administrate our competitions; and
  • on other occasions where we ask you for consent, we will use the data for the purpose which we explain at that time. 

Children

We recognise that children aged 13 to 16 may use our site to learn about careers in racing and how to gain work experience in the industry. However, we do not intentionally collect, offer services to or maintain data about anyone under the age of 13.

Withdrawing consent

Wherever we rely on your consent (for example, where we ask for permission to send you marketing emails) you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes.  To withdraw your consent at any time, please email info@careersinracing.com or activate the unsubscribe function on an email.

Who will we share this data with, where and when?

We share your information with IT data processors that provide services to the BHA. They host, support, and maintain our software.

We also share data with other processors that provide services such as digital consultancy, user experience design, email database hosting, and service email distribution. It may be necessary for us to transfer your personal information outside of the UK under agreements with such processors, where this is the case, this will be done in accordance with UK data protection law.

We share information with social media platforms to support targeted marketing (e.g. Facebook custom and lookalike audiences). The BHA acts as a joint controller with Facebook Ireland for this processing. To opt out of this, to review your settings or to submit a data protection rights request, you can change your settings directly on your social media account.

Personal data may also be shared with government authorities or law enforcement if mandated by law or where required for the legal protection of our legitimate interests in compliance with applicable laws.

We will share your personal data for the purposes of contacting your referees.

We will share your personal data with training providers delivering training or education programmes such as the British Racing School (‘BRS’) for the purpose of considering and administrating your application for a training programme and in the event that you are successful, your personal data will be shared with the training provider delivering such programme.

Where you have applied to be added to our talent pool, your details will be shared with the BRS who will provide riding assessments and potential employers where you have expressed an interest in a position.

Information shared in public areas of the site, or included in a CV or profile database, may be accessed and used by third parties. We are not responsible for how third parties use personal data that has been shared publicly.

What rights do I have?

You have the right to ask us for a copy  of your personal data; to correct, delete or restrict (stop any active) processing of your personal data; and to obtain the personal data you provide to us for a contract or with your consent in a structured, machine-readable format, and to ask us to share (port) this data to another controller.

In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement).

These rights may be limited, for example, if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping.

We hope that we can satisfy any queries you have about the way we process your data but, if you have unresolved concerns, you have the right to submit a data protection complaint.

Data protection complaints

You have a right to complain to the BHA if you consider that we have not handled your personal information in compliance with data protection legislation. For example, you may submit a complaint about how the BHA has responded to a data protection rights request or how the BHA has collected or used your information.

Please send the details of your complaint together with your name and relationship with the BHA through to dataprotection@britishhorseracing.com, using ‘Careers in Racing – Data Protection Complaint‘ as the subject line. You may be asked to provide proof of your identity or authority to submit the complaint on behalf of someone else.

Once we have verified your identity, the BHA will acknowledge receipt of your complaint within 30 days and start investigating the issue. We will keep you informed of our progress and communicate the outcome of your complaint without undue delay.

If you are unhappy with the outcome of your complaint, you also have the right to complain to the Information Commissioner’s Office (ICO). For further information about the ICO’s complaints process please refer to their complaints page.

How do I get in touch with you, or your data protection officer?

We hope that we can satisfy queries you may have about the way we process your data. If you have any concerns about how we process your data, or would like to opt out of direct marketing, you can get in touch at dataprotection@britishhorseracing.com.

How long will you retain my data?

Where you are successful in your application, we will retain your personal data for a period of three years following the end of your programme or placement or from the date of receipt of your application, whichever is longer.

We retain applications from unsuccessful applicants for one year following the date of receipt.

Where we process your personal data on the basis of your consent, we do this for as long as your consent is active.

Changes to this privacy notice

Any changes to this privacy notice will appear on this page. Where appropriate, we will also notify you by email. Please check this page regularly for updates or changes.
